NRC publishes final rule decoupling fusion from fission regulatory framework
U.S. nuclear regulator finalizes Part 53 amendments that treat fusion under a byproduct-materials regime.
The Nuclear Regulatory Commission published the final version of its rule formally separating fusion energy systems from the 10 CFR Part 50/52 fission framework. Fusion facilities will be regulated under an extended Part 30 byproduct-materials regime, with site-specific licensing pathways for higher-activity components.
Industry advocates broadly welcomed the rule, which had been anticipated since the 2023 NRC staff recommendation. The Fusion Industry Association said the decision “removes the single largest source of U.S. regulatory uncertainty for private fusion investment.”
